Welcome to STL Home Lenders ("we," "us," "our," or the "Company"), operated through the website stlouishomelenders.com (the "Site"). By accessing, browsing, or using the Site in any manner, including but not limited to submitting information through any form on the Site, you ("you," "your," or "User") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").

If you do not agree to all of these Terms, you must immediately discontinue use of the Site. Your continued use of the Site following the posting of any changes to these Terms constitutes your acceptance of those changes.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and STL Home Lenders regarding your use of the Site.

2. Description of Service

STL Home Lenders operates a lead generation service designed to connect consumers in the St. Louis, Missouri metropolitan area and surrounding regions with licensed mortgage lenders and loan officers.

STL Home Lenders is NOT a mortgage lender, mortgage broker, bank, credit union, or financial institution. We do not originate, fund, underwrite, service, or negotiate mortgage loans of any kind. We do not make credit decisions, set interest rates, determine loan terms, or approve or deny mortgage applications.

Our service works as follows:

  • We provide an online form through which consumers can submit basic information about their mortgage needs, financial situation, and contact details.
  • We share the submitted information with one or more licensed Missouri mortgage lenders, loan officers, or lending partners within our network.
  • Those licensed professionals may then contact the consumer directly to discuss mortgage options, provide quotes, and guide them through the lending process.

Our service is provided at no cost to consumers. We generate revenue through partnerships with lending professionals and may receive compensation when a consumer is connected with a lending partner or when a loan is ultimately originated.

We do not charge consumers any fees for the use of our Site or for the submission of information through our forms.

3. Consent to Contact

By submitting your personal information through any form on the Site, you expressly consent to the following:

  • Phone Calls: You consent to receive telephone calls, including calls made using an automatic telephone dialing system or prerecorded/artificial voice messages, from STL Home Lenders and/or our lending partners at the telephone number(s) you provide, regarding your mortgage inquiry and related products or services.
  • Text Messages (SMS/MMS): You consent to receive text messages, including messages sent via automatic telephone dialing systems, from STL Home Lenders and/or our lending partners at the telephone number(s) you provide. Message and data rates may apply. Message frequency varies. You may opt out of text messages at any time by replying STOP.
  • Email: You consent to receive emails from STL Home Lenders and/or our lending partners at the email address you provide, regarding your mortgage inquiry, related products and services, and marketing communications.

TCPA Consent: By submitting your information and providing your telephone number, you provide your prior express written consent under the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and any applicable state laws, to receive calls and text messages (including those made using an autodialer or prerecorded messages) from STL Home Lenders, our lending partners, and their agents, at the number you provide, for purposes related to your mortgage inquiry. This consent is not a condition of purchasing any property, goods, or services. You may revoke your consent at any time by contacting us at contact@stlouishomelenders.com or by following opt-out instructions provided in any communication you receive.

You acknowledge that you may be contacted by multiple lending partners and that the number and frequency of contacts will vary based on the information you provide and the number of lending partners to whom your information is shared.

4. Information Sharing

By submitting your information through the Site, you acknowledge and agree that:

  • Your personal information, including but not limited to your name, phone number, email address, property information, desired loan amount, credit profile, and other details you provide, will be shared with one or more licensed mortgage lenders, loan officers, or lending partners in our network for the purpose of providing you with mortgage quotes, pre-approval information, and related services.
  • Once your information has been shared with a lending partner, that lending partner's own privacy policy and terms of service will govern their use of your information.
  • We do not control and are not responsible for the privacy practices or the actions of our lending partners. We encourage you to review the privacy policies of any lending partner who contacts you.
  • Your information may be shared with lending partners located in the State of Missouri and, where applicable, other states.

5. No Guarantee

STL Home Lenders makes no guarantees, representations, or warranties regarding:

  • Your approval or qualification for any mortgage loan or financial product;
  • Specific interest rates, loan terms, closing costs, fees, or other financial terms;
  • The availability of any particular loan program or product;
  • The number of lending partners who will contact you or the timeliness of their response;
  • The quality, reliability, or competence of any lending partner in our network;
  • The accuracy of any estimates, quotes, or pre-qualification results provided by lending partners.

All lending decisions, including loan approval, interest rates, loan terms, and all other aspects of any mortgage transaction, are made solely and exclusively by the licensed lending professionals and financial institutions to whom your information is shared. These decisions are based on the lender's own underwriting criteria, your creditworthiness, and applicable laws and regulations.

Any information displayed on the Site regarding interest rates, loan programs, or mortgage terms is for informational and illustrative purposes only and does not constitute an offer to lend, a commitment to lend, or a guarantee of any specific terms.

6. User Obligations

By using the Site and submitting information through our forms, you represent and warrant that:

  • Age: You are at least eighteen (18) years of age or the age of majority in your state of residence, whichever is greater.
  • Legal Authority: You have the legal capacity and authority to enter into these Terms and to submit information on your own behalf or, if submitting information on behalf of another person, you have that person's express authorization to do so.
  • Accurate Information: All information you provide through the Site is truthful, accurate, current, and complete. You understand that providing false, misleading, or fraudulent information may result in the denial of a mortgage application and may violate federal and state laws.

  • No Interference: You will not attempt to interfere with the proper functioning of the Site, including but not limited to transmitting viruses, malware, or other harmful code, or attempting to gain unauthorized access to our systems.
  • No Scraping: You will not use any automated means, including bots, crawlers, scrapers, or similar technologies, to access, collect, or copy any content or data from the Site without our prior written consent.

7. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, trademarks, service marks, images, icons, page layout, software, and the overall design and "look and feel" of the Site (collectively, "Content"), is the exclusive property of STL Home Lenders or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its Content for personal, non-commercial purposes only. You may not:

  • Copy, reproduce, distribute, publish, display, modify, or create derivative works based on the Content;
  • Use any Content for any commercial purpose without our prior written consent;
  • Remove or alter any copyright, trademark, or other proprietary notices from any Content;
  • Frame or mirror any part of the Site on any other website or server.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT, SERVICES, AND FEATURES PROVIDED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STL HOME LENDERS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
  • WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE SITE;
  • WARRANTIES REGARDING THE QUALITY OR SUITABILITY OF ANY LENDING PARTNER IN OUR NETWORK.

YOU ACKNOWLEDGE THAT YOUR USE OF THE SITE IS AT YOUR SOLE RISK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM STL HOME LENDERS OR THROUGH THE SITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STL HOME LENDERS, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR PARTNERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA;
  • DAMAGES ARISING FROM YOUR INABILITY TO OBTAIN A MORTGAGE LOAN OR SPECIFIC LOAN TERMS;
  • DAMAGES ARISING FROM THE ACTIONS, OMISSIONS, OR CONDUCT OF ANY LENDING PARTNER;
  • DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR INFORMATION;

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF STL HOME LENDERS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL STL HOME LENDERS' TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to indemnify, defend, and hold harmless STL Home Lenders, its owners, officers, directors, employees, agents, affiliates, and partners from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising from or related to:

  • Your use of or access to the Site;
  • Your violation of these Terms;
  • Your violation of any applicable law or regulation;
  • Any information you submit through the Site that is inaccurate, false, or misleading;
  • Your infringement of any third party's intellectual property or other rights;
  • Any dispute between you and a lending partner connected through our service.

This indemnification obligation shall survive the termination of these Terms and your use of the Site.

11. Third-Party Links and Services

The Site may contain links to third-party websites, services, or resources that are not owned or controlled by STL Home Lenders, including but not limited to the websites of our lending partners, government agencies, and other informational resources.

We provide these links as a convenience and for informational purposes only. The inclusion of any link does not imply our endorsement, sponsorship, or recommendation of the linked website or its content.

We have no control over and assume no responsibility for the content, privacy policies, practices, or availability of any third-party websites or services. You acknowledge and agree that STL Home Lenders shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any content, goods, or services available on or through any third-party website.

We strongly encourage you to review the terms of service and privacy policies of any third-party website you visit.

12. Governing Law

These Terms and any disputes arising out of or related to these Terms or your use of the Site shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law principles.

You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in St. Louis City or St. Louis County, Missouri, and you hereby consent to the personal jurisdiction and venue of such courts.

13. Dispute Resolution

Informal Resolution: Before initiating any formal legal proceeding, you agree to first contact us at contact@stlouishomelenders.com and attempt to resolve any dispute informally for a period of at least thirty (30) days. Most concerns can be resolved quickly through informal communication.

Binding Arbitration: If we are unable to resolve a dispute informally, you and STL Home Lenders each agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site (excluding claims for injunctive or other equitable relief) shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in St. Louis, Missouri, or at another mutually agreed-upon location.

Class Action Waiver: YOU AND STL HOME LENDERS AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration against STL Home Lenders.

Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the jurisdictional limits of such court.

14. Modifications to Terms

STL Home Lenders reserves the right to modify, update, or revise these Terms at any time and at our sole discretion. When we make changes, we will update the "Last Updated" date at the top of this page.

Material changes will be communicated through a prominent notice on the Site or, where practicable, by email to registered users. Your continued use of the Site after any modifications to these Terms constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically to stay informed of any updates. If you do not agree with the revised Terms, you must discontinue your use of the Site.

15. Termination

We reserve the right to suspend, restrict, or terminate your access to the Site at any time, with or without cause and with or without notice, at our sole discretion. Reasons for termination may include, but are not limited to:

  • Violation of these Terms;
  • Submission of false, fraudulent, or misleading information;
  • Conduct that we believe is harmful to other users, lending partners, or our business;
  • Use of the Site for any unlawful purpose.

Upon termination, all provisions of these Terms that by their nature should survive shall remain in effect, including but not limited to Sections 7 (Intellectual Property), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 10 (Indemnification), 12 (Governing Law), and 13 (Dispute Resolution).

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall remain in full force and effect.

The invalidity or unenforceability of any provision in one jurisdiction shall not affect the validity or enforceability of that provision in any other jurisdiction.

STL Home Lenders is a lead generation and marketing service. We are not a lender, do not make loans, and do not make credit decisions. We do not offer or negotiate terms for mortgage loans.

Information provided on the Site, including blog posts, articles, guides, and rate information, is for general informational purposes only and should not be construed as financial advice, legal advice, tax advice, or a recommendation to enter into any specific mortgage transaction. You should consult with qualified financial, legal, and tax professionals before making any financial decisions.

Participation by a lending professional in our network does not constitute our endorsement or recommendation of that lender. We do not guarantee the licensing status, qualifications, or performance of any lending partner, though we make reasonable efforts to work only with licensed professionals.
